Your use of the NETVIGATOR Roaming Service is subject to you agreeing that:

1. The NETVIGATOR Subscriber terms and conditions shall equally apply to your use of any other third party service provider's online or Internet access service as part of the Roaming Service;
2. You will be charged additional fees based on per minute usage (or part thereof) for using the Roaming Service. A full list of fees and charges is set out in the [Roaming Directory];
3. You are responsible for ensuring that you have all the proper hardware and software to access and use the Roaming Service;
4. Any software which you download from NETVIGATOR or that is otherwise supplied to you to facilitate access to the Roaming Service shall constitute "Software" for the purposes of the NETVIGATOR Subscriber terms and conditions;
5. Access to the Roaming Service may not be available at all times; and
6. PCCW IMS Limited disclaims any representation, warranty or responsibility in relation to the technical specifications or performance of the Roaming Service.
